Terms of Service
Lazy Potato Express, Inc.
Effective Date: September 27, 2026
Last Updated: September 27, 2026
These Terms of Service (“Terms”) govern access to and use of websites, accounts, products, support systems, digital products, and services provided by Lazy Potato Express, Inc., an Idaho corporation (“Lazy Potato Express,” “LPE,” “we,” “us,” or “our”).
1. Agreement to These Terms
By creating an account, placing an order, submitting a support request, purchasing or requesting services, entering into a project agreement, or otherwise using our websites or services, you acknowledge that you have read and agree to these Terms and applicable policies or project-specific agreements incorporated into them.
Nothing in these Terms is intended to waive or limit any right or remedy that cannot lawfully be waived or limited.
2. Websites Covered
- www.lazypotatoexpress.com
- store.lazypotatoexpress.com
- support.lazypotatoexpress.com
3. Related Policies
Depending on your use of our services, these Terms incorporate our Store Terms and Conditions of Sale, Shipping Policy, Returns and Refunds Policy, Gemstone and Natural Materials Disclosure, Services and Custom Work Terms, Acceptable Use and User Content Policy, Privacy Policy, and any accepted project-specific agreement. If project-specific written terms conflict with these general Terms for that project, the project-specific terms control to the extent of the conflict.
4. Eligibility
You must be at least 18 years old and have legal capacity to enter into a binding agreement. If applicable law requires a higher age for the applicable transaction or agreement, you must satisfy that higher age requirement.
5. Accounts
An account is required to place store orders and submit support requests. You are responsible for maintaining the confidentiality and security of your credentials and reasonably using available account-security features. You must provide reasonably accurate and current information and may not impersonate another person, access another account without authorization, use an account unlawfully, or interfere with our systems.
6. Suspension and Termination
We may restrict, suspend, or terminate accounts for violations of these Terms, fraud or suspected fraud, abusive conduct, security threats, unlawful activity, nonpayment, fraudulent or abusive chargebacks, or conduct reasonably believed to threaten LPE, its customers, systems, or third parties. Serious violations may be referred to appropriate authorities or pursued through lawful remedies.
7. Products and Services
We may provide computer repair and technical services; coding and web-development services; writing and digital products; gemstones, rough material, stone slabs, and related materials; custom projects; and additional products or services introduced later. Availability is not guaranteed merely because an item or service appears on a website.
8. Website and Listing Accuracy
We make reasonable efforts to provide accurate information. Websites and listings may occasionally contain typographical errors, inaccurate descriptions, incorrect prices, inventory discrepancies, technical errors, or other mistakes. We may correct errors, update information, change or discontinue products or services, and cancel or refuse an affected order when reasonably necessary. If we cancel a paid order because of our error, amounts collected for the canceled item will be refunded as required by applicable law and our policies.
9. Intellectual Property
Except for customer-owned content and third-party material, our websites and original content, software, photographs, graphics, branding, designs, text, documentation, and other materials are owned by or licensed to LPE and protected by applicable intellectual-property laws. No ownership transfers except where expressly stated in writing.
10. Third-Party Services
Our services may interact with independent payment processors, shipping carriers, hosting providers, software providers, and other service providers. Their own terms and privacy policies may apply. LPE is not responsible for an independent third party’s acts or omissions except to the extent applicable law provides otherwise.
11. Prohibited Use
You may not use our services for unlawful activity, malicious software distribution, unauthorized access, system interference, harassment, fraudulent orders or claims, infringement, or other abusive activity.
12. Disclaimer of Warranties
Except for rights or warranties that cannot lawfully be excluded, and except where a separate written agreement expressly states otherwise, products are provided “AS IS” and “WITH ALL FAULTS” and websites and online services are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by applicable law, LPE disclaims implied warranties, including merchantability and fitness for a particular purpose, where such warranties may lawfully be disclaimed. Nothing here excludes rights that applicable law does not permit us to exclude.
13. Limitation of Liability
To the maximum extent permitted by applicable law, LPE will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from a product, service, website, account, transaction, or project. To the maximum extent permitted by law, LPE’s aggregate liability arising from a particular product, service, transaction, or project will not exceed the lesser of (a) the amount actually paid to LPE for the matter giving rise to the claim or (b) the maximum limitation permitted by applicable law. This limitation does not apply where law prohibits or restricts it.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold LPE harmless from third-party claims, losses, or reasonable expenses arising from your unlawful use of our services, violation of these Terms, infringement of another person’s rights, or content you submit, except to the extent caused by LPE conduct for which liability cannot lawfully be shifted.
15. Dispute Resolution
Informal Resolution
Before formal proceedings, the parties agree to make a reasonable good-faith effort to resolve the dispute directly. Written notice may be sent to legal@lazypotatoexpress.com.
Mediation
If informal resolution is unsuccessful, the parties agree to make a reasonable good-faith attempt at mediation before arbitration unless impracticable, mutually waived, or applicable law provides otherwise.
Binding Individual Arbitration
If unresolved, the dispute shall, to the extent enforceable, be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under applicable AAA Consumer Arbitration Rules and Mediation Procedures. Nothing prevents relief in a court where applicable law provides a non-waivable right or applicable rules permit it.
Class-Action Waiver
To the maximum extent permitted by law, disputes subject to arbitration will proceed individually and not as class, collective, consolidated, or representative proceedings. This does not eliminate rights that applicable law makes non-waivable.
Governing Law
These Terms are governed by Idaho law, without regard to conflict-of-law principles, except where federal law applies or another jurisdiction provides rights that cannot lawfully be displaced.
16. Exceptions
A voluntary exception or customer accommodation does not amend these Terms, establish a continuing course of dealing, waive future enforcement, or require the same exception in another situation.
17. Changes
We may update these Terms as operations or legal obligations change. Updated Terms will show a revised Last Updated date. Material changes may receive additional notice when appropriate or required. Changes apply prospectively unless applicable law or an accepted agreement provides otherwise.
18. Severability
If a provision is unlawful or unenforceable, it will be enforced to the maximum extent legally permitted or severed as necessary while remaining provisions continue in effect.
